DELIVERY, RETURNS AND WARRANTY POLICY

SELLER AND BUYERS

For the purposes of this policy:

– Consumer means a natural person purchasing goods for personal purposes unrelated to their business, trade, craft or professional activity.
– Business Buyer means a legal entity or a natural person purchasing goods for business, trade, craft or professional purposes.

DELIVERY

Available delivery methods and prices are displayed at checkout after the Buyer enters the delivery address. The delivery price for non-standard, oversized or heavy goods may be agreed individually.

Goods that are in stock are normally delivered within 1–3 business days. In exceptional cases, delivery may take up to 14 days. The Buyer will be informed in advance if a longer delivery period applies. Delivery times for custom-made, special-order or out-of-stock goods are agreed separately.

Information on whether a product is delivered assembled, disassembled or otherwise prepared for transport is provided in the product description or individual quotation.

The Seller is responsible for the safe transport of the goods until they are handed over to the Buyer or a person designated by the Buyer.

COLLECTION OF GOODS

No delivery fee applies when the Buyer collects the goods from the MB “Hukas” retail location at Klaipėdos pl., Gobergiškė, 96169 Klaipėda District Municipality, Lithuania.

After the goods have been handed over, the Buyer must use a vehicle suitable for their dimensions, weight and characteristics and ensure their safe transportation.

RETURNS OF GOODS PURCHASED ONLINE BY CONSUMERS

A Consumer has the right to withdraw from a distance sales contract without giving a reason within 14 calendar days from the date on which the goods were received.

The Consumer must clearly notify the Seller of the decision to return the goods by emailing pardavimai@hukas.lt. The notification should preferably include the order number, details of the goods being returned and the Consumer’s contact details.

The goods must be dispatched or delivered to the Seller no later than 14 calendar days after the Consumer notifies the Seller of the withdrawal.

Returned goods must be sent or delivered to: MB “Hukas”, Klaipėdos pl., Gobergiškė, 96169 Klaipėda District Municipality, Lithuania.

The Consumer may inspect and test the goods only to the extent that would be possible in a physical store. The Consumer is responsible for any reduction in the value of the goods resulting from handling beyond what was necessary to determine their nature, characteristics and functioning.

Returned goods must include all supplied components, be undamaged and be suitably packed for transportation. Consumers are advised to retain the original packaging, labels, instructions and any other documents supplied with the goods.

The Consumer bears the direct cost of returning goods of satisfactory quality.

REFUNDS

The Seller will refund the amounts received from the Consumer no later than 14 calendar days after receiving the notice of withdrawal. The Seller may withhold the refund until the goods have been returned or the Consumer provides evidence that they have been dispatched.

If the Consumer withdraws from the entire contract, the Seller will refund the price of the goods and the cost of standard delivery. Additional costs resulting from the Consumer choosing a delivery method more expensive than the standard delivery method offered by the Seller will not be refunded.

The refund will be issued using the same payment method used for the original transaction unless otherwise agreed with the Consumer.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The 14-day right to withdraw from a distance contract does not apply in the cases provided by the laws of the Republic of Lithuania, including:

– goods made according to the Buyer’s individual specifications or clearly personalised for the Buyer;
– timber and other products cut to individual dimensions, processed, painted, impregnated or otherwise specially prepared for the Buyer;
– goods that are liable to deteriorate or expire rapidly;
– sealed goods that are not suitable for return for health protection or hygiene reasons after being unsealed;
– services that have been fully performed where performance began with the Consumer’s express consent and acknowledgement that the right of withdrawal would be lost once the service had been fully performed;
– other cases provided by applicable law.

The fact that a product is an electrical appliance or professional equipment does not by itself remove a Consumer’s right to withdraw from a contract concluded online.

GOODS PURCHASED IN A PHYSICAL STORE

Electrical goods of satisfactory quality and other non-returnable goods listed in the Lithuanian Retail Trade Rules and purchased from a physical retail location may be exchanged or returned only with the Seller’s consent.

This restriction does not apply to defective goods and does not automatically apply to goods purchased online by a Consumer.

PURCHASES BY BUSINESS BUYERS

The Consumer’s 14-day right of withdrawal does not apply to Business Buyers. Goods of satisfactory quality purchased by a Business Buyer may be returned only with the Seller’s prior written consent and under the conditions specified by the Seller.

The quality, warranty, return and liability conditions applicable to purchases by Business Buyers are determined by the individual quotation, contract, product description, manufacturer’s documentation and applicable law.

LEGAL GUARANTEE AND DEFECTIVE GOODS

Consumers are entitled to a two-year legal guarantee. The Seller is responsible for any lack of conformity that existed when the goods were delivered and became apparent within two years of delivery.

In the event of defective goods, the Consumer may request repair or replacement in accordance with applicable law. Where the statutory conditions are met, the Consumer may request a proportionate price reduction or terminate the sales contract.

The repair or replacement of defective goods and any necessary transportation costs are provided to the Consumer free of charge.

Goods will be repaired or replaced within a reasonable period and without causing significant inconvenience to the Consumer, taking into account the nature of the goods, the complexity of the defect and the availability of the necessary parts.

Professional equipment purchased by a Business Buyer for business or professional purposes is covered by a 12-month commercial warranty unless a different period is stated in the product description, manufacturer’s documentation, quotation or contract.

If professional equipment is purchased by a natural person for personal purposes unrelated to business or professional activity, the statutory consumer rights, including the two-year legal guarantee, apply. A commercial warranty does not restrict these statutory rights.

WARRANTY EXCLUSIONS

The warranty does not cover faults or damage caused by:

– improper use or use for purposes other than those intended;
– incorrect installation or failure to follow the manufacturer’s instructions;
– an improperly prepared base or foundation;
– insufficient or incorrect maintenance;
– mechanical damage, vandalism or an accident;
– unauthorised disassembly, alteration or repair;
– normal wear and tear;
– extreme weather conditions or other external factors beyond the Seller’s control.

These exclusions do not restrict the Consumer’s rights where a defect existed at the time of delivery or resulted from the goods failing to meet applicable quality requirements.

NATURAL CHARACTERISTICS AND MAINTENANCE OF TIMBER

Timber is a natural material. Differences in colour, texture, grain and knots, as well as minor cracks, dimensional changes, resin discharge or colour changes caused by environmental exposure, are not considered defects if they are consistent with the natural characteristics of timber and do not materially affect the strength or intended use of the product.

Wooden products used outdoors must be maintained regularly and treated with protective products suitable for their intended purpose. The Buyer must ensure a suitable base, protection from constant contact with moisture, adequate water drainage and ventilation.

Fixings may loosen over time and must therefore be inspected regularly and tightened when necessary.

SAFE INSTALLATION

Suitable tools and personal protective equipment must be used when installing the products. The manufacturer’s installation and operating instructions must be followed.

Before installation, the Buyer must check the condition and completeness of the goods. If any parts are missing, damaged or unsuitable, the Seller must be informed as soon as possible. Installation should not begin if doing so could increase the damage or make it more difficult to determine the cause of the defect.

CLAIMS AND DISPUTE RESOLUTION

For defective goods, warranty service or other order-related matters, the Buyer must contact the Seller at pardavimai@hukas.lt. The Buyer should provide proof of purchase, the order number, a description of the issue and, where possible, photographs or video recordings.

The Seller will examine a Consumer’s claim free of charge and provide a detailed, reasoned written response no later than 14 calendar days after receiving it.

If a dispute with a Consumer cannot be resolved, the Consumer may contact the Lithuanian State Consumer Rights Protection Authority or submit a request through the Consumer Rights Information System at www.vtis.lt.
